One of the most important fundamentals of our profession are ethics. Most think of ethics as how we conduct ourselves with clients and witnesses, and how we conduct our investigations. These are our professional morals - and violating them can become a serious problem for ourselves, our clients and our professions.

What is often overlooked are those ethics involving our interactions with our colleagues - in our agency ethics, Section III - Colleague Relations. Paragraph 2 of this section is one most overlooked and witnessed by us, and it speaks of personal and professional honesty and integrity.

"As Professional Investigators and Expert Consultants we shall not directly or indirectly injure the professional reputation, prospects, or practice of another investigator. However, if we consider that an investigator is guilty of unethical, illegal, or unfair practice or designs, we shall present the information to the proper authority for action."

You are only as good to yourself and your clients with your honesty and integrity - your personal and professional character.

New service - Equivocal Death Analysis - Flat Fee (from 12/6/2011)
At Associates in Forensic Investigations, LLC (AFI-LLC), we have found that families, as well as our colleagues and attorney clients, are often unsure if a complete investigation is necessary, or how to determine the necessity of a full Equivocal Death Investigation.  Often, just the assurance that a proper investigation was completed is all that is necessary, and warranted.

What is the value of hiring a PI for background checks and investigations? (from 12/9/2011)
Over the years it has been increasingly easy for the private citizen to check the backgrounds of other individuals at little to no cost.  In many states, various public records have been made more available directly, or by data services reselling data.  At the same time, there have been more restrictions on records that can be accessed, often requiring a PI license, or redacted considerably or completed banned from access.  One record that is easy and free, in most jurisdictions and via online sources are the sex offender registrations - from local to national.  But, each of these resources does no good if not used, used improperly or not verified.

What are Equivocal Death Investigations and Equivocal Death Analysis? (from 1/1/2012)
What does it mean to conduct an Equivocal Death Investigation or Analysis (EDI, EDA)?  We get asked this question time and time again.  An Equivocal Death Investigation is an in-depth investigation into a death that has lingering questions.  Many families have come to us for help in understanding the circumstances surrounding a loved one’s death.  The manners of death can be classified as any of the following:  homicide, suicide, natural, accident or undetermined.  Sometimes the family/loved one of the deceased individual does not agree with the final determination and have a yearning for more answers.

Pre-Conference Certification Event! September 14, 2017 
The CDITC in partnership with the Professional Private Investigators Association of Colorado will be hosting the CDITC 8 hour Forensic Interviewing Certification course. The focus of this course is to introduce and certify the participants in FTER – Forensic Testimonial Evidence Recovery concepts and techniques.  This course focused upon criminal defense investigation and builds upon the concepts of forensic investigative interviewing.

National Association of Legal Investigators (www.NALI.com)
NALI is the premier association for legal investigators for civil plaintiff and criminal defense, and oversees the prestigious Certified Legal Investigator (CLI) program.  Experience is required to join and all members are subject to a background check.

Each day we find an increasing number of problems confronting the orderly growth of our profession. How Concealing Key Evidence Convicts the Innocent
The Crime Report

On June 22, in Turner vs. United States, the Supreme Court, by a 6 to 2 vote, affirmed the murder convictions of seven men. Unlike most Supreme Court decisions, Turner went largely unnoticed.
It deserves more attention, but not because it announced a new legal rule. Instead, Turner reaffirmed a terrible old rule that has done great harm to the accuracy of criminal trials, and will continue to do so.

When a Client Asks a Private Investigator to Do Something Illegal
Dean Gluth, 2nd VP of NCISS, shared this update from our friends at PI Now / PI Round Up, featuring our Colorado friends and colleagues, Robert and Andrea Orozco (Advanced Professional Investigations; Andrea is NCISS 3rd VP and PPIAC VP of Legislative Affairs, and Robert is a NCISS member and PPIAC Past President).

Firing or Refusing to Work With the Client
"On the specific scenario of being asked to enter a home and obtain physical evidence, Robert and Andrea Orozco said, “Even if the investigator is allowed entry into the residence, perhaps for obtaining a statement, it doesn’t give the investigator the liberty to take anything from the residence without permission from the homeowner.” An earlier commenter shared that attorney clients have encouraged him to use his best judgment in these scenarios, to which the Orozcos reply, “Those types of clients should be avoided. We’ve fired many clients for many reasons, and unethical/illegal requests, particularly after being advised of such - is at the top of the list.” Darryl Daugherty, an investigator who works in Thailand, said that these people don’t become clients, but rather failed prospects."

Vidocq Lifetime Achievement Award - Vernon Geberth 'Mr. Murder' - Practical Homicide Investigation - NYPD (Commander, Ret.)


The following news came us from our friend, Vernon Geberth. He is humbled and excited about such an honor - a well deserved one.

"I am proud to announce that I have been selected to be the recipient of the Vidocq Society’s “Halbert E. Fillinger Lifetime Achievement Award.” The Award Ceremony and Banquet will be held at The Belle Voir Manor located at 1601 State Road in Bensalem, Pennsylvania on Sunday October 1, 2017 at 6:00 P.M.

I am honored and flattered to be recognized for my contributions to the law enforcement profession throughout my years of service, research and dedication to the investigation of murder and cold case homicide investigation.

The “Halbert E. Fillinger Lifetime Achievement Award” is named in honor of Dr. Halbert Fillinger who was a forensic pathologist. His 40 years of service included his time as Chief Medical Examiner in the Philadelphia Medical Examiner’s Office before being elected Coroner of Montgomery County, PA. During his career, Dr. Fillinger lectured many times at the FBI academy in Quantico, Va., and all branches of the Armed Forces. Respected for his work, officials in the states of Texas, Michigan, Arkansas, Kentucky, Georgia, New York, New Jersey, and Colorado sought his advice.
I certainly appreciate that the award is named after Doctor Halbert E. Fillinger, who was a dear friend, colleague and mentor to me early in my career. We had the opportunity to teach together at various events back in the 1990’s."

Legislative News You Can Use... from NCISS
Legislative Activity Summary for July
In the month of July, Congress was almost completely focused on passing some sort of repeal and replacement of the Affordable Care Act (ACA, a.k.a. "Obamacare").  As such, very few other matters were considered in the legislature, and we are all surely familiar with the end result (at least, for the time being) of the ACA repeal vote.

During this time, Lobbyit focused on legislation which would provide states anti-trust protection for occupational licensing requirements, provided they instituted reforms to ensure such requirements were not anti competitive.  Lobbyit met with the Federal Trade Commission (FTC), the office of Senator Mike Lee, and with the Senate Judiciary Committee to discuss this issue.
