Educating Congress and Our Recent Travels...
We hope each of you are having a wonderful Spring! About the time of drafting this newsletter, Dean returned from the Annual Meeting and Hit the Hill event of the National Council of Investigation & Security Services (www.NCISS.org), and we are both now in Miami for the Mid-Term Meeting of the World Association of Detectives (www.WAD.net), for which Karen is the Administrative Manager and Dean is the Governor of the Americas.
 
The NCISS Hit the Hill was very successful, with several members – and even better, several first time attendees – both new and veteran members – arriving in Washington DC to meet with our Senators and Representatives, and their legislative aids, to discuss important upcoming legislation and regulations. This year the luncheon was in the US Capitol, Senate Visitors Center, with keynote speaker Rep. Steve Stivers of Ohio. Important legislation was discussed by our members (please see below).
 
NCISS also held annual elections of Officers and Directors. Dean’s term as President came to a close and he was elected by the Board to be Board Chairman for the next year. His term was busy and productive, thanks to the teamwork and individual commitment of each officer and director in their duties. Success was achieved by everyone, Together We’re Better! It has been an honor and privilege for Dean to serve the members of NCISS, and also the investigative and security professions.
 
Dean didn’t leave empty handed – he also returned to Colorado having been honored with NCISS’s highest honor, the Duffy Award [LINK]. The recipient is chosen by a committee of the six most recent recipients. In presenting the award, Past President and recipient Maria Landry described their decision:

This was a great honor for Dean, and quite a surprise. As a recipient, he credits the teamwork and accomplishments of the Executive Council, Board and support of members. Last year (2016) Dean was honored to be the recipient of the second most coveted award, The Wunder Award. Like the Duffy Award, the recipient of this award is also determined by a committee of the six most recent recipients. In 2012, as a Regional Director, Dean was the first recipient of the Vinson Award www.nciss.org/awards.

This award was created for the Executive Council (only Officers) to select the recipient, and has been intended for someone not on the Executive Council. After receiving the award, it was realized that Dean is also the only member to receive all three awards (Past President Vince Ruffolo had received the Duffy Award and Wunder Award, and posthumously the Vinson Award in 2013).

Following the NCISS Annual Meeting and Hit the Hill event, Dean and Karen traveled together to the the World Association of Detectives Mid-Term meeting in South Miami Beach FL. As the Administrative Manager, Karen was introduces to many members of WAD and assisted with the meeting organization and welcoming members. There was time to relax on the beach and a tour of the Everglades.

The Necessity of Complete Backgrounds (from 01/17/2015)
When I first wrote ‘Professional Locate Investigations’ (www.ProfessionalLocateInvestigations.com) it was intended to be a guide to one of the most common tasks of all private investigators – locating people.  Several years later we decided an updated edition was needed to fill in some gaps and update some information to be more current.  In the investigative world being current is important, but keeping resources current is a daunting task.  That is one reason we value trade magazines, trade blogs and other sources by fellow professionals.  The new edition was revamped and designed to demonstrate the similarities of locate investigations, background checks and assets & liabilities checks.  Full investigations, more than just gathering records, most often follows – but you have to start with the records.

Gunshot Residue (GSR) and Testing (from 02/12/2015)
During our combined years at the medical examiner's office (spanning from late 2002 to late 2008), we collected GSR from every decedent with a cause of death due to a gunshot wound; every investigator did.  However, the state laboratory had no longer accepted them for testing unless specific circumstances would warrant it.  We cannot recall any submissions of GSR to the state lab.  Instead it was recommended to collect DNA swabs from the decedent, firearm and other relevant evidence.  Dean wrote the procedure that remains in place today.  Since returning to the private sector in late 2008, we have not had a case inquiring or requesting GSR testing - until recent months.  In one case GSR was completed by the agency as routine protocol, and in two private consultations we demonstrated the unreliability of GSR and recommended more definitive alternative protocols for the cases.  With these recent cases, we decided some information was needed.  The information below is simplified and not intended to relate any scientific processes or principles beyond some explanation.

Life Insurance Fraud and Illegal Beneficiaries (from 03/11/2015)
In our world of Equivocal Death Investigations, we are often tasked with bringing closure to families in the loss of a loved one (see www.UnderstandingDeathInvestigations.com).  This may include the unasked question of life insurance benefits.  This is because many life insurance policies have double indemnity clause – or payment of twice the policy benefits if the death is ruled an accident.  Conversely, many life insurance policies have a clause that denies benefits if the death is ruled a suicide.  These may also have clauses that, in the event of benefits, the terms are limited – for example a suicide two or more years after a policy is written is payable.  Similarly, there are issues of survivor and workers’ compensation benefits in the event of accidents and death.  These are all very important, and often unrealized, issues when families may need the expertise of our services and legal counsel.

Professional Private investigations Association of Colorado (www.PPIAC.org) Monthly meetings are the first Wednesday of each month, usually in the Denver metro area.  PPIAC continues to hold specialized training sessions for new and veteran investigators, and also specific to the new licensing program.

Together We're Better - Educating Congress...
NCISS is Your Voice in our Nation’s Capital!

How important are the relationships NCISS, through its members, has developed over the years? Keith Nelson of Lobbyit shared key points from the recent meetings by members on the Hill. Here is a summary of Keith’s message.
 
The month of March was dominated by preparations for and execution of the official NCISS 2017 Hit the Hill (HTH) event. NCISS members and management gathered in Washington, Dc for their Annual Meeting and Hit the Hill (HTH) legislative action day. Keith Nelson of Lobbyit attended the Monday members’ meeting, and gave a Tuesday morning briefing, on what to expect during their Hill meetings, discussed the legal and legislative topics we were presenting, and covered how best to conduct effective advocacy.
 
Later that morning, as part of HTH advocacy, Lobbyit took NCISS leadership to sit down with legislative staff for Congressman Jason Chaffetz (R-Ut3), the sponsor of the GPS Act, which NCISS opposes. The GPS Act would make it a criminal offense to track persons and property via electronic means without their consent. In this meeting was discussion on how and why private investigators (PI) utilize GPS, and solicited their agreement to carve out/exempt PIs from the Act’s prohibitions.  Staff took voluminous notes, and asked us for legislative language which would accomplish our goals. Lobbyit and NCISS are currently in the process of reviewing the relevant state exclusions and drafting language for their consideration.
 
Later in the day, Lobbyit had a quick meeting with counsel from the Senate Judiciary Committee (the committee of jurisdiction for the Senate version of the GPS Act [Wyden, D-Or]); 1st Vice President Brad Duffy met with Senate Judiciary Chairman Senator Charles Grassley. Judiciary staff were equally interested in reviewing language exempting PIs from GPS prohibitions, and Lobbyit will be following up with them in the near future. This is a critical relationship, because as Chairman, Grassley can hold Wyden’s bill until Wyden concedes to our amendments. Even though the Chaffetz meeting went very well, we are heartened that we have a solid backstop in the Senate committee of jurisdiction.
 
NCISS then attended the luncheon in the Capitol Visitors Center, during which we were addressed by Representative Steve Stivers, Member for Columbus Ohio, who sits on the Financial Services Committee and is now the Chairman of the National Republican Congressional Committee (NRCC), the political body responsible for getting Republicans elected to the House of Representatives. At the Hill luncheon, Representative Stivers (R-OH) recognized incoming NCISS president, Terry Myer, and in doing so, gave his commitment to help NCISS with the GPA language in the House. Overall, a resounding success.

Legislative News You Can Use...
In meeting with our Senators and Representatives with their aids, NCISS members shared the following important legislative items being monitored. For our investigative and security agencies to best serve their clients, keeping access and use of the tools we use for legitimate purposes is important.
 
The “Geolocational Privacy and Surveillance Act” or the “GPS Act”
Licensed investigators are often acting pursuant to litigation, with GPS technology employed for a variety of important purposes. GPS technology allows PIs to track movements remotely, removing the need for close observation and/or actual physical “tailing,” which is itself a risky endeavor. Congress must not foreclose the use of GPS by licensed investigators in the course of their normal business. 
 
The Anti-Spoofing Act of 2017
Licensed investigators are in the business of uncovering information, often to be used in formal legal proceedings, which the target individuals typically are deliberately hiding.  PIs employ simple misdirection to acquire basic information, like confirming residency, location, or employment status.
 
This bill seeks to prohibit the use of false identifying information for phone calls and texts.  While this limitation is apparently limited to false “caller ID” numbers, it could easily be construed to include “pretexting,” or simple subterfuge employed by PIs for legitimate purposes; clarification is needed to ensure that pretexting is not inadvertently restricted.
 
Department of Labor Regulations -- (The Ambush, Joint Employer, and EEOC Pay Reporting Rules)
A series of rules were issued by the previous administration which significantly restricts the ability of business owners to manage their enterprises according to their best judgment.  In the 114th Congress, several legislative attempts were made to overturn such rules. Congress should work to eliminate or modify such rules with respect to the legitimate purposes of PIs.
