Lincoln Kyle is 1 year old!
We love our grandchildren and bragging about them - who doesn't?! Lincoln is our youngest and 4th - his sister, Jacee Sue is our oldest and only granddaughter (she is 8 years old), and their cousins, Gage Alan and Cash Michael, are 7 and will be 8 years old in July.

This picture was after he recently visited with us for a day and was tired, ready to go home. He is as cute and handsome as can be - and smiles as much as he crawls, which is non-stop!

World Association of Detectives Mid-Term Meeting
Last month, following Dean's NCISS Mid-Term Meeting in Washington DC, we hit the skies for Miami Beach, FL. As the Administrative Manager, this was Karen’s first opportunity to meet many of the WAD members, many visiting from Europe and Asia – from England and France, to Romania and Russia, and India to Malaysia. This was Dean's third WAD event and welcomed the opportunity to see old friends and meet new ones. Look for a special announcement about our agency and WAD's Annual Meeting later this year.

On a different note of advice, after this we decided to get cleared by TSA Pre Check. For just $85 every five years, per person, you can be issued a Known Traveler Number after having a fingerprint background check completed and a TSA interview. We had ours completed within days.

"I am sure many of you have heard by now about one of our own, Dean Gluth, and the horrible car accident he suffered this week [Tuesday 04/25]. A small group of us visited with him in the Intensive Care Unit at the hospital yesterday. Although his body is beat up pretty bad, he still has his sense of humor and his spirits were up as well, thanks to all of the support from friends and loved ones. Honestly, after his property was recovered, he was most concerned with his case work and membership recruitment for NCISS. Many of you have reached out and asked how to help. Last night, his family set up a Go Fund Me page in Dean’s honor. I have attached the link here. He is going to need assistance with the cost of medical care and will obviously be unable to work for some time. If you are able to post half a day of billable hours or even your lunch money, anything will help! At some point Dean will see the support. The link also gives a description of what happened and his injuries."

On Tuesday night April 25th, Dean was traveling home to Chicago from Indianapolis after watching his daughter coach a high school softball game. At approximately 10:00pm while driving through a construction zone, Dean's tire got caught in a groove on the road which caused him to lose control of the vehicle. His truck flipped over the guardrail on the side of the highway and rolled into a ditch. The police estimate that his truck rolled at least 10 times down the hill. He was extracted from his totaled vehicle with the jaws of life. He was then taken to the Emergency Room where it was discovered he sustained a broken pelvis, 5 broken ribs, a punctured lung, and a severe concussion. Indiana State Police said that it was a miracle he survived the incident.

Update Friday 04/29/2017 - Dean was released from the hospital! We all wish him the best, and a speedy recovery!

Keep up with the current events of our agency and profession through our blog.  Dating back to the fall of 2011, there are dozens of articles, tips and resources for professional investigators.

Balancing the Financial and Resource Scales of Justice (from 3/31/2015)
Let’s look at the recent example.  For a fraction of this $20 million wrongful conviction settlement could be an increase in the funding and resources for the defense would be a start.  Next, fix the budget and resources for the prosecution to the same as the defense, and fine the prosecution the $20 million.  In another case, the former prosecutor offers this, “Had I been more inquisitive, perhaps the evidence would have come to light years ago. But I wasn't, and my inaction contributed to the miscarriage of justice in this matter. Based on what we had, I was confident that the right man was being prosecuted and I was not going to commit resources to investigate what I considered to be bogus claims that we had the wrong man.”  In other words, this prosecutor shared only that evidence with the defense that is only supporting guilty.  That is exactly the point of his, and so much, prosecutorial misconduct. A poor attempt at apologizing through justifying his actions.

Danger of PI Apps (from 6/20/2015)
This is in response to the following story, which is important to read to understand the context and concerns presented.  This story was shared by friend and colleague, Ron Rugen (Team Investigations, LLC of Kansas City, MO).  We also invite you to read Ron’s similarly thought provoking commentary at his agency blog - http://www.kc-pi.com/2015/06/new-app-to-hire-private-investigator-not-good.  The author of this article, Tania Anderson, asked to publish Dean's rebuttal by 06/17/2015; however, she never has.  During this same week we have noticed a lot of online activity within our profession expressing similar concerns.  We are not worried about losing business to an app – we don’t provide the services the app purports.  What we are concerned about, as with all of our colleagues, is the damage this activity can do to our profession and consumers.  It is our responsibility to not accept irresponsible, possibly illicit, activities.

Assuring You AFI Investigators are Licensed (from 6/2/2015)
Colorado's voluntary licensure program was repealed in June 2014 after the passage of mandatory licensure, effective June 01, 2015. At that time ALL persons asserting to be a private investigator and providing services defined by statute will have to be licensed (there are exemptions for in-house investigators and other limited persons (see the rules and statute). Reporting of operating without a license is mandatory - and with the cost of licensure, reporting non-compliance assures both consumer and professional protection from unlicensed activity.

Dru Sjodin National Sex Offender Public Website (NSOPW)
Known as Dru's Law - the Dru Sjodin National Sex Offender Public Website (NSOPW) includes the National Sex Offender Registry. In 2004 NCISS Hit the Hill attendees included something on their list of bills that they were actually supporting rather than opposing. Over 40 of us Hit the Hill that year and encouraged support and passage of this legislation. Our efforts garnered national media attention.

The proposed legislation was sponsored by Sen. Byron Dorgan of North Dakota and was simply known as "Dru's Law". A year later, Dru's Law, or the National Sex Offender Registry was included as part of the Adam Walsh Child Protection and Safety Act which is an Act to protect children from sexual exploitation and violent crime, to prevent child abuse and child pornography, to promote internet safety, and to honor the memory of Adam Walsh and other children victims of crimes.  The bill was signed into law by President George W. Legislative News You Can Use...
As Congress continues working on legislation primarily focused on the new administration, other legislation and regulations seem to be on hold. As a reminder, here is what is still hot in our nation's capital...

In meeting with our Senators and Representatives with their aids, NCISS members shared the following important legislative items being monitored. For our investigative and security agencies to best serve their clients, keeping access and use of the tools we use for legitimate purposes is important.
 
The “Geolocational Privacy and Surveillance Act” or the “GPS Act”
Licensed investigators are often acting pursuant to litigation, with GPS technology employed for a variety of important purposes. GPS technology allows PIs to track movements remotely, removing the need for close observation and/or actual physical “tailing,” which is itself a risky endeavor. Congress must not foreclose the use of GPS by licensed investigators in the course of their normal business. 
 
The Anti-Spoofing Act of 2017
Licensed investigators are in the business of uncovering information, often to be used in formal legal proceedings, which the target individuals typically are deliberately hiding.  PIs employ simple misdirection to acquire basic information, like confirming residency, location, or employment status.
 
This bill seeks to prohibit the use of false identifying information for phone calls and texts.  While this limitation is apparently limited to false “caller ID” numbers, it could easily be construed to include “pretexting,” or simple subterfuge employed by PIs for legitimate purposes; clarification is needed to ensure that pretexting is not inadvertently restricted.
 
Department of Labor Regulations -- (The Ambush, Joint Employer, and EEOC Pay Reporting Rules)
A series of rules were issued by the previous administration which significantly restricts the ability of business owners to manage their enterprises according to their best judgment.  In the 114th Congress, several legislative attempts were made to overturn such rules. Congress should work to eliminate or modify such rules with respect to the legitimate purposes of PIs.

Law firms and medical offices specialize - Professional Investigators also specialize.  Their casework and continuing education should also be in your specialized areas.

Experience and Knowledge
Professional Investigators strive to maintain and further these. All professions have requirements of continuing education.  The CLI and CCDI programs both require extensive compliance with continuing education.

Responsible and Ethical Conduct
Every component of the investigation has evidentiary considerations. Professional Investigators hold themselves to a higher standard and leaves no question as to the admissibility of their evidence.  Information without ethics is not evidence.

Effective Communication
Professional Investigators maintain communication with the attorney, client, witnesses, and other key persons in the investigation.  Moreover, reports are the product of an organized investigation and should reflect the work product you expect.

Thomson Reuters named Steve Davis of Steve Davis and Associates as one of three recipients of its Everyday Hero award for Davis’ efforts to locate Hannah Hrabik, a missing 25-year-old woman.
