PIs - Are You Personally Attending Training and Conferences?
As the summer comes to an end, and kids (and grandkids) return to school - this is also the time of year many training conferences happen, and the final ones of the year. We gladly share these events and dates, and a few are just around the corner.

As professionals, the continued education and training we each receive not only betters ourselves, doing so also betters our profession and the services provided to clients. With growing webinars, distance learning, and podcasts - and we participate in each of these - the personal attendance of training and conference events continue to be on the decline.

The cost of travel, the event, and being away from business can be expensive. However, there are returns on this investment you only get from personally attending. Not only is there better networking, camaraderie among friends, and a more personal learning experience - there is much more from a personal interactive experience, more than continuing education and training. Supporting  the associations you belong to (or should) is one. These events take several months to plan and are expensive - the actual per-person cost far exceeding the registration fees, thanks to sponsors and donors. You personally learn more about the vendors and products, and the speakers and their services.

We attend our state association annual conference, (www.PPIAC.org), which has continually become one of the best in the country. We also attend at least one other national or regional association meeting each year (NCISS, NALI, WAD, CDITC, ICI) and other state associations. This expands not only our knowledge base, also our resources and personal networking. With several, it isn't possible to attend all, but at least two is a great benefit and also supports the associations.

Top Tip of 2019 for our PI Colleagues...
If you need to find assistance outside of your area, here are steps to take to find a vetted and reliable professional:
1. Don't throw your request for assistance out to unvetted groups in social media or generic listserves. Why trust your business and your client to the unknown? Its bad business. Sure, they're free - but you get what you pay for.
2. Reach out to someone you know and trust in the area.
3. Reach out to the state or specialty association - join them.
4. Reach out to a national association - NCISS and NALI vet their membership to be in compliance with licensing and ethics - join them.
5. If international, reach out to WAD (they also vet their membership to be in compliance with licensing and ethics) - join them.
6. Vet your decision, including through your associations network.
 
Its your reputation. We give preference to professionals supporting our profession and holding membership in their state associations, NCISS, NALI and WAD, and specialty associations such as CDITC - many of which are cross members - join them. Through our memberships we have a trusted network of thousands in almost every state and almost 100 countries. We have a very personal network of over 2000 PIs we personally know and trust. That happened through our interactions in associations who support and grow our profession.

Don't just join - be active! We are involved in every association we belong to - not just as members, but from committees to the board, and Karen is the Administrative Manager or Executive Director of two.

Learn the Basics of Death Investigations (02/05/2013)
This continuing education based death investigation course is a basic introduction into the concepts of the official investigation of death, such as by a coroner or medical examiner office, and the role that the private investigator may play in an equivocal death investigation. As might be expected, there are similar roles, overlapping roles and, of course different roles and responsibilities.  Although developed for continuing education, the concepts and methodology are suitable for any private or government sector investigator looking to expand their investigative knowledge into the basics of death investigation, and even personal injury investigations and injury causation.

Scene Investigations - Part 1 and 2 from 2012 (02/20/2013)
One of our best articles from 2012 was from Karen, and was two parts covering the importance of scene investigations.
 
As investigators we get the opportunity to investigate all aspects of a case.  Sometimes a case may require some scene work. 

Even if at first it appears that the case does not require a visit to the scene, if you have the opportunity, it is always recommended to go back where the event first began.  Whether the case involves a death, a motor vehicle accident, or some type of crime, take the extra time, go that extra mile and visit the scene.  You might be surprised once you visit the scene to find out that something could not have occurred the way the witness, victim or police officer claims.  It is best not to rely on others to do the work you need to do yourself.  You are the investigator, and someone is depending on you to see, hear, and get an overall feel of what the scene was like.

What are Equivocal Death Investigations and Analysis? (02/26/2013)
What does it mean to conduct an Equivocal Death Investigation or Analysis (EDI, EDA)?  We get asked this question time and time again.  An Equivocal Death Investigation is an in depth investigation into a death that has lingering questions.  Many families have come to us for help in understanding the circumstances surrounding a loved one’s death.  The manners of death can be classified as any of the following:  homicide, suicide, natural, accident or undetermined.  Sometimes the family/loved one of the deceased individual does not agree with the final determination and have a yearning for more answers.

Case Studies from AFI-LLC

We are often asked about the types of traumatic injury and death cases we review - from family equivocal deaths to civil and criminal cases for attorneys and investigators. Each month we will present two previous cases - of hundreds - with a variety of circumstances, evidence, and conclusions.

Domestic Relations Settlement Offer Reduced (by nearly 85%) - (Legal Investigation)
In a case that had elements of all the investigative techniques available, our agency was able to uncover material evidence that played a pivotal role in assisting our client in their domestic relations settlement.  The opposing party began at $300,000 (which would have included liquidating real property and retirement assets).  During the settlement conference the opposing party reached $185,000 and was countered at $50,000.  Announcing they were unprepared to make any decisions, the opposing party discontinued discussions.  During the course of the following two months, our agency uncovered several areas of discrepancy in the background of the opposing party.  This included false disability claims (*again, Karen found video on a social media site of the opposing party dancing at a town festival, and statements of them being capable of walking over two miles without any mobility aids).  Additional information included false information about their military background, financial background, unlawful transfer of assets (using our network of colleagues, one found the vehicle in a rural area based on social media information).  Finally, the same efforts in the background found the the opposing party was able-bodied to work.  These efforts resulted in a settlement equal to that in discussions two months prior and a preservation of assets.
 
Suspicious Death - Suicide or Homicide (Independent Investigation)
Our agency was retained by next-of-kin to review the official records, reports, photographs and additional evidentiary information into the shooting death of a relative.  The decedent was found inside his locked apartment, by co-workers after not reporting to work.  He was lying supine with a semi-automatic handgun near his left leg, between a dining table and kitchen counter.  There was no indication another person had been with him approximate to the time of his death.  He resided alone and the front door was locked; however the sliding glass balcony door was unlocked (2nd level).  Prior to his death he had experienced multiple life stressing experiences, including relationship breakups.
 
The law enforcement investigation revealed multiple investigative deficiencies, and the death was ruled a suicide.  It was determined that these were mostly protocol that did not inhibit the investigation.  The most significant discrepancy was failing to note or investigate the unlocked sliding door.
 
The evidence suggests and supports that the decedent was alone at the time of his death.  Additionally, the decedent was not moved from another location or position within this location, including within the apartment.  There were no indications of assault, mutual combat or defense.  There is no evidence to suggest or support homicide, or that the scene and evidence were staged or altered.
 
This case was previously reviewed by multiple forensic experts, who concluded Undetermined as the appropriate Manner of Death.  These reviewed reports did not take into account multiple key points of evidence (such as no ability for another person to have been present and positioned to act).  Another example, was that perhaps the decedent mistook the handgun for his cell phone and was calling 911 (even intoxicated, as he was, the weight and manner of holding and completing a call are not the same as the operation of a semi-automatic handgun; and his cell phone was in his bedroom).
 
Our agency review of the empirical evidence and events concluded that the fatal shot could not have been from a person, other than the decedent, due to his location and furnishings, and final resting position.  Consequential evidence, including body position and blood spatter, were consistent with the bullet trajectory (into the walls and ceiling).
 
Conclusively, this death was not as a consequence of homicide.

Freelance site Fiverr allowing illegal PI services

On the heels of Trustify dying (see last month’s newsletter), now freelance site Fiverr allowing illegal PI services.
Freelancer site Fiverr is also a site where you can buy malware to illegally spy on your spouse, pay someone to place a GPS tracker on a car, or hire an unlicensed private investigator, according to Fiverr listings.

It should be noted, when notified of these practices, Fiverr did respond and remove reported violators for being 'Illegal or fraudulent services' violate our terms of service by doing so. Fiverr also removed a reported unlicensed private investigator.
 
As noted by Robert, it is pretty interesting as some of the services being offered are pretty intrusive. This article is another reason to show that for consumer protection, there is simply nothing else as effective as PI licensing.
 
As noted by Dean, this is no surprise, Fiverr is cheap and international - there is no control in those environments and more will pop up. This should be a warning - if someone goes outside a licensed PI, and gets in legal trouble – that is their issue to deal with.
 
As both noted, unfortunately, these services – like Trustify - become our profession’s issues and cause  more damage to the PI reputation.


Criminal-case outcome studies - Charging & Sentencing Analysis
Another R3 sentencing study success. The criminal defense attorney said our analysis of cases involving similar assaults provided the extra nudge needed to get to a favorable outcome of his plea negotiations.
Rich Robertson, CLI and his team at R3 are incredible. There are a few back stories to this study - starting with Rich's personal lawsuit for the right to these public records in AZ - and winning. Then continuing to develop the only such system in AZ (maybe the country). We need to sit down with Rich and his team on this!
