Celebrating 32 Years - AFI-LLC Newsletter October 2019

This month we celebrate 28 Years together, and 20 Years married!
It began 10/15/1991 when Dean's roommate (John) went for a quick ride to his mom's gift shop in LaPorte, and Dean joined. There, Dean saw a striking woman talking to John's mom. They were introduced with some small talk.

Later that evening, while at a friend's, Dean was paged by his roommate to see if there was any interest in Karen; of course! Karen was asked the same by
John's mom. From there, it all started.

The next day, before their first date, Dean was hit on his motorcycle and in the recuperation they spent time getting to know each other.

A few weeks later, Dean would meet Jeberly (then 10) and Winter (then 8). Nine years later we would marry on the date we met. Our lives saw many ups, and some downs. So many wonderful stories to tell and share, so much love we have had and continue as we grow together on this highway our lives have found and follow to our future.

Our daughters have grown, have wonderful careers and families. We have four grandchildren - Jeberly is mom to Jacee (10) and Lincoln (3), and Winter is mom to identical twins Gage and Cash (10 - six months younger than Jacee)!

This month we celebrate 32 Years in business!
On October 1st 1987, Dean filed his business registration with Colorado as simply - Investigative Services - and still maintains the registration now 32 years later.


It has been a long, great ride with so much history. In 1996 Karen joined part-time, and later full-time. Since 2008 Team Beers (because two Beers are better than one) has focused on death and serious bodily injury investigations and expert consultations nationwide. Today Karen primarily assists with family cases, and as Administrative Manager of WAD, and Executive Director of NCISS.

We give a special thanks to all our family, friends and colleagues who have been with us for the ride in support and friendship. Of course, our clients - some from the first days 32 years ago, hold a special place and thanks! - Dean and Karen

Fatal crash ruled murder after autopsy uncovers gunshot wound to victim's head
INDIANAPOLIS — A fatal crash over the weekend is now a homicide after an autopsy uncovered a gunshot wound to the victim's head.
Indiana State Police first responded to the two-vehicle crash on I-70 near the 96 mile marker around 7:23 p.m. Saturday. The victim was found unresponsive inside one of the vehicles and pronounced dead at the scene. The injuries were believed to have been from the collision, until the autopsy.

This is why motor vehicle are investigated and autopsied beyond an accident... a scenario Dean uses often as an example recently to CDITC Academy students (including a self-inflicted gunshot wound while exiting an interstate near Pueblo CO in the early 2000s).

At the Mid-Term, discussion followed the rising concerns of pending legislation, in the interest of additional consumer privacy, which would greatly impact the ability of professional investigators to obtain vital information for their clients. Two recent successes from the assistance of NCISS to supporting state associations were discussed, and show the importance of these partnerships of associations and members.

Utah (Tina Thomas, Regional Director):
Utah Rep. Marie Poulson introduced House Bill 0223 “Unlawful Installation of a Tracking Device.” earlier this year. Licensed private investigators in Utah was faced with proposed legislation which would have made it illegal for licensed private investigators in the state to use GPS in the normal scope of a legitimate investigation. The state association, PIAU worked with NCISS and other interests including prosecutors and law enforcement to allow private investigators to use GPS for a legitimate business purposes.

California (Kelly Cory, Regional Director):
Assembly Bill 5 legislation that was proposed to change the way subcontractors were classified with regards to worker status. The new ABC approach would pretty much prevent investigators from subcontracting to other investigators by the definition of the way it was written. With legislative action from CALI and NCISS, licensed private investigators were exempted from the new law.

Scene Investigations - Conducting vs. Completing the Investigative Process (02/20/2013)
As investigators we get the opportunity to investigate all aspects of a case.  Sometimes a case may require some scene work.
 
Even if at first it appears that the case does not require a visit to the scene, if you have the opportunity, it is always recommended to go back where the event first began.  Whether the case involves a death, a motor vehicle accident, or some type of crime, take the extra time, go that extra mile and visit the scene.  You might be surprised once you visit the scene to find out that something could not have occurred the way the witness, victim or police officer claims.  It is best not to rely on others to do the work you need to do yourself.  You are the investigator, and someone is depending on you to see, hear, and get an overall feel of what the scene was like.

What are Equivocal Death Investigations and Equivocal Death Analysis? (02/26/2013)
What does it mean to conduct an Equivocal Death Investigation or Analysis (EDI, EDA)?  We get asked this question time and time again.  An Equivocal Death Investigation is an in depth investigation into a death that has lingering questions.  Many families have come to us for help in understanding the circumstances surrounding a loved one’s death.  The manners of death can be classified as any of the following:  homicide, suicide, natural, accident or undetermined.  Sometimes the family/loved one of the deceased individual does not agree with the final determination and have a yearning for more answers.

The Question of Suicide in Equivocal Death Investigations (03/18/2013)
From Voltaire, “To the living we owe respect. To the dead we owe only the truth.”  That is the purpose of an Equivocal Death Analysis and Investigation (EDA or EDI); collectively referred to as equivocal death case review.  One of the most common questions in death investigation is:  "Was it a Suicide?"  This question may often go unanswered due to lack of sufficient official investigation or attention to evidence.  This leaves the possibility of closure for the families impossible, particularly if foul play is suspected, or even an accident.  The wrong determination can also result in benefits, such as life insurance or workers’ compensation, underpaid - or worse, denied.

Case Studies from AFI-LLC

We are often asked about the types of traumatic injury and death cases we review - from family equivocal deaths to civil and criminal cases for attorneys and investigators. Each month we will present two previous cases - of hundreds - with a variety of circumstances, evidence, and conclusions.

Domestic Relations Settlement Offer Reduced (by nearly 85%) - (Legal Investigation)
In a case that had elements of all the investigative techniques available, our agency was able to uncover material evidence that played a pivotal role in assisting our client in their domestic relations settlement.  The opposing party began at $300,000 (which would have included liquidating real property and retirement assets).  During the settlement conference the opposing party reached $185,000 and was countered at $50,000.  Announcing they were unprepared to make any decisions, the opposing party discontinued discussions.  During the course of the following two months, our agency uncovered several areas of discrepancy in the background of the opposing party.  This included false disability claims (*again, Karen found video on a social media site of the opposing party dancing at a town festival, and statements of them being capable of walking over two miles without any mobility aids).  Additional information included false information about their military background, financial background, unlawful transfer of assets (using our network of colleagues, one found the vehicle in a rural area based on social media information).  Finally, the same efforts in the background found the the opposing party was able-bodied to work.  These efforts resulted in a settlement equal to that in discussions two months prior and a preservation of assets.
 
Suspicious Death - Suicide or Homicide (Independent Investigation)
Our agency was retained by next-of-kin to review the official records, reports, photographs and additional evidentiary information into the shooting death of a relative.  The decedent was found inside his locked apartment, by co-workers after not reporting to work.  He was lying supine with a semi-automatic handgun near his left leg, between a dining table and kitchen counter.  There was no indication another person had been with him approximate to the time of his death.  He resided alone and the front door was locked; however the sliding glass balcony door was unlocked (2nd level).  Prior to his death he had experienced multiple life stressing experiences, including relationship breakups.
 
The law enforcement investigation revealed multiple investigative deficiencies, and the death was ruled a suicide.  It was determined that these were mostly protocol that did not inhibit the investigation.  The most significant discrepancy was failing to note or investigate the unlocked sliding door.
 
The evidence suggests and supports that the decedent was alone at the time of his death.  Additionally, the decedent was not moved from another location or position within this location, including within the apartment.  There were no indications of assault, mutual combat or defense.  There is no evidence to suggest or support homicide, or that the scene and evidence were staged or altered.
 
This case was previously reviewed by multiple forensic experts, who concluded Undetermined as the appropriate Manner of Death.  These reviewed reports did not take into account multiple key points of evidence (such as no ability for another person to have been present and positioned to act).  Another example, was that perhaps the decedent mistook the handgun for his cell phone and was calling 911 (even intoxicated, as he was, the weight and manner of holding and completing a call are not the same as the operation of a semi-automatic handgun; and his cell phone was in his bedroom).
 
Our agency review of the empirical evidence and events concluded that the fatal shot could not have been from a person, other than the decedent, due to his location and furnishings, and final resting position.  Consequential evidence, including body position and blood spatter, were consistent with the bullet trajectory (into the walls and ceiling).
 
Conclusively, this death was not as a consequence of homicide.
