Things you like to hear from clients...
We consulted on a physical assault case, with evidence supporting the defendant's statements. Defendant would not accept a plea offer, stating innocence.
 
We received this note from the attorney - "Just wanted to let you know that we went to trial on this case the first week in July. He was found not guilty of all three counts!"

Did you know most PIs DO NOT attending continuing education opportunities?
Some do when required by their licensing authority - Colorado does not. Others do as required for certifications. Continuing education is important to both PIs and clients, and we encourage all of our colleagues to join us in making ourselves better. It is more than continuing education... it is building important resources for clients.
 
These requirements vary from 10 to 25 hours per year. How much do we report annually? On average, 75 to 150, including authorships and lecture presentations. In July, Dean acquired 50, and Karen 24. We have previous hours, and several more coming up.
 
The other benefit is networking to better our agency, services to clients, and resources. One recent example - did you know there are multiple points a stored vehicle activity data, which includes location mapping? Popular body worn electronic devices may tell how fast a vehicle was going at the time of a collision, or medical conditions at the time? Or the GPS location at the time of a collision or similar events? We will be telling our clients about these valuable tools and resource!

This month’s new commentary has been posted on our agency website - “Death of a Flim Flam” on our blog, is now available.  Our agency, and profession, was first alerted to this when friend and colleague Ron Rugen, in Missouri, posted his blog in early June 2015. We did also, with our own analysis and in response to an article pushing this service. We never received a response from this Flim Flam or the author of the article, nor was our response published – as had been promised; no surprise.
 
What was previously known as “Flim Flam” was the original business name being a bit too revealing of what the ‘app’ and service actually was – and a name change to what it was not, “Trustify”. Founded in March of 2015, it took only a few months to be exposed in our profession; however, it took four years to see it finally collapse.

We are often asked about the types of traumatic injury and death cases we review - from family equivocal deaths to civil and criminal cases for attorneys and investigators. Each month we will present two previous cases - of hundreds - with a variety of circumstances, evidence, and conclusions.

Multiple Sex Assault Charges (Criminal Defense Investigation)
Our agency was pleased to learn that an extensive criminal defense investigation, which uncovered new and relevant information, was material in the outcome in the best interests of all involved. The complex case took extensive team work to review the records and reports provided in disclosure, as well as extensive research and interviews that revealed mitigating factors, and verified reported information, which enabled an informed decision making process. The rights and personal integrity of all involved were ultimately protected.
 
* It should be noted that Karen's social media background investigations uncovered over 70 pages of evidence, by the reporting party, that contradicted her reported statements and also uncovered multiple similar allegations in another state that would not have been uncovered by any conventional records check.
 
Homicide and Aggravated Assault Charges (Expert Consultation)
Our most common investigations and consultations involve death and injury causation, and analysis of the integrity of the official investigation and evidence.
 
Our agency was excited to learn that another extensive criminal defense investigation has materially aided in causing the prosecution to revisit their case and request conferences with defense in the shadows of trial. Having uncovered undisclosed evidence, destroyed evidence, missing evidence, new witnesses and circumstances not disclosed by witnesses - the defense was prepared to call one key expert witness. The prosecution offered an amended charge from First Degree Murder to Second Degree Manslaughter.  The prosecution was further compelled to offer the same to the co-defendant under separate legal representation.
 
This new and relevant information, was material an outcome in the best interests of all involved. The complex case took extensive AFI-LLC team work to review the records and reports provided in disclosure, as well as extensive research. This revealed the relevant evidence (and lack or destruction thereof) which enabled an informed decision making process. The rights and personal integrity of all involved were ultimately protected.

The state’s theory stretched the physical limits of the human body. Somehow on the night of Oct. 30, 1994, Lamar Johnson left his friend’s apartment, traveled three miles to Marcus Boyd’s front porch with one other man, killed Boyd, fled on foot and arrived back at the apartment to continue socializing with friends — all in “no more than five minutes."
 
Now, the St. Louis Circuit Attorney’s Office says it knows how prosecutors managed to convince a jury it was true: Police and prosecutors made up the evidence, according to a 67-page motion seeking to vacate Johnson’s first-degree murder conviction and grant him a new trial after 24 years behind bars.

From Bill Elliott, CLI CCDI – “This stuff happens folks, I had a case where seven (7) witnesses were receiving instructions on what to say from an inmate inside the state pen.   The inmate wanted the defendant who had no involvement in the crime to be convicted and sentenced to the pen so the inmate could personally kill him.  Stay alert and dig deep.”

Private investigator could lose his license for placing tracking device on West Fargo woman's SUV

North Dakota law is unclear on whether private investigators are prohibited from using tracking devices.
 
In a rare case, a private investigator has been convicted of placing a tracking device on a West Fargo woman’s SUV last year and could lose his license for what he called a common practice in his profession.
 
The North Dakota Private Investigation and Security Board plans to review an administrative complaint against Jon Daniel Jacobson, 46, the owner of 701 Investigations in Fargo, said Monte Rogneby, an attorney for the board. Prosecutors have said the Leonard, N.D., man's actions were inappropriate and intruded on personal property.
 
Comment: Like North Dakota, Colorado law is unclear on whether private investigators are prohibited from using tracking devices. In North Carolina and other states it is very clear that licensed private investigators may do so, with specific permitted purposes and when not otherwise violating state law (i.e. trespassing). Conversely, in Florida and other states it is very clear this is not permitted by private investigators and does violate state law. NCISS continues to watch as Congress decides how to address this issue.

Landmark CA Supreme Court Decision Favors Release of Private Social Media Posts to the Defense

For years, social media companies have opposed efforts by criminal defense attorneys to access accounts, arguing that federal privacy law — the Stored Communications Act — bars cooperation except in limited circumstances.
 
In the past, only law enforcement has been able to force social media companies to provide private postings.  In the present case, Defense attorneys have served subpoenas on Facebook, Instagram and Twitter in an effort to gain access to private, public and deleted postings from the accounts of the deceased victim and the prosecution witness. Under the CA Supreme Court ruling, the defense will now have access to the deleted and private social media postings of the victim and prosecution witnesses.

Officer Zachary Wester, who was fired last September, was arrested Wednesday and charged with 52 counts of racketeering, false imprisonment, official misconduct, fabricating evidence and possession of controlled substances, among other charges. He’s accused of indiscriminately targeting innocent drivers and hauling them off to jail after planting meth or marijuana in their vehicles while feigning a “search."
 
“There is no question that Wester’s crimes were deliberate and that his actions put innocent people in jail,” Chris Williams, the Florida Department of Law Enforcement’s assistant special agent in charge.

Justice Department resumes use of death penalty, schedules five executions

The U.S. Justice Department on Thursday reinstated a two-decades long dormant policy allowing the federal government’s use of capital punishment and immediately scheduled the executions for five death row federal inmates.

“Congress has expressly authorized the death penalty through legislation adopted by the people’s representatives in both houses of Congress and signed by the President,” Attorney General William Barr said in a statement. 

“The Justice Department upholds the rule of law - and we owe it to the victims and their families to carry forward the sentence imposed by our justice system.”

U.S. President Donald Trump has called for increasing the use of the death penalty for drug traffickers and mass shooters, a request the Justice Department has since laid the groundwork to carry out.

Lobbyit Update – In Congress and Inside the Beltway
As regular readers of The Advocate are aware, NCISS, through our DC representatives at Lobbyit, continue to track the content and development of the various measures proposed under the general rubric of “data privacy”.  Spurred first by the European Union’s GDPR, then California’s CCPA, Congress continues to work on an overall legislative package which would regulate the collection of information generated via use of the internet, and provide consumers greater insight as to what was collected, enhanced control over what information is allowed to be collected, and more say over its eventual disposition.

NCISS and State Leadership Legislative Roundtable Conference Call
NCISS continues to monitor federal legislation in Washington, DC through our lobbyist representation and through the diligent efforts of its volunteers. As you may know, NCISS is supported by individual members and association members. Those association members provide great support to NCISS in making us effective. Presently, we have over 35 active associations which help advance our banner and goals. We want to thank them for all that they do.
 
Recently, NCISS launched a new initiative to assist our association members. Last month, NCISS hosted our first legislative roundtable conference call. Hosted by myself and Andrea Orozco, NCISS President. Prior to the call, we asked all of our state associations to designate one member (whether President or Legislative Chair or State Board Member) to call in and participate. We are glad to report that we had over thirty (30) association representative join in. During the call, we discussed an ongoing framework to communicate on a regular basis with our associations needs and nationwide legislative movements.
