In April of 2014 our friends at PursuitMag.com published our 'Legal Pitfalls, Ethical Perils, and Moral Quandaries for Professional Investigators' at http://pursuitmag.com/ethical-legal-moral-private-investigators. This is as timely now, as then - and is perpetually relevant.

As professional investigators, we have certain legal, ethical, and moral obligations. The problem is: not everybody agrees on what those are.

For apprentice investigators and veterans alike, our legal obligations lie at the foundation of everything we do. But ethical and moral professional behavior reside in murkier areas, with very unclear boundaries.

You can also download our FREE Ethics Book for PIs and Attorneys.  The value and importance of our professional ethics cannot be overstated. Ethics are often seen as morals, they are not, though one will impact the other. Morals behavioral guides that are personal and individualistic. Ethics are rules of behavior for an individual through a group – such as an association or profession.

Personal Morals and Professional Ethics (new commentary posted 03/05/2018)
Personal Morals and Professional Ethics – what is the difference? We have written, and given presentations, extensively on professional ethics; including a free distance learning course on ethics in the relationship of the professional investigator and attorney client. One of the few times personal morals comes into the equation is when the issue of moral turpitude is raised – particularly in professional licensing. Moral turpitude refers to an act or behavior which violates the standards of the community. This is about professional investigations – not personal advocacy.
 
Doing something, or not, based on any scope of one’s personal life – is personal.
 
Doing something, or not, based on business practices – is professional.

Scene Investigations - Conducting vs. Completing the Investigative Process (02/02/2013)
Even if at first it appears that the case does not require a visit to the scene, if you have the opportunity, it is always recommended to go back where the event first began.  Whether the case involves a death, a motor vehicle accident, or some type of crime, take the extra time, go that extra mile and visit the scene.  You might be surprised once you visit the scene to find out that something could not have occurred the way the witness, victim or police officer claims.  It is best not to rely on others to do the work you need to do yourself.  You are the investigator, and someone is depending on you to see, hear, and get an overall feel of what the scene was like.

We are often asked about the types of traumatic injury and death cases we review - from family equivocal deaths to civil and criminal cases for attorneys and investigators. Each month we will present two previous cases - of hundreds - with a variety of circumstances, evidence, and conclusions.

Attempted Homicide and Aggravated Assault with a Deadly Weapon
-- Our agency’s most common investigations and consultations involve death and injury causation, and analysis of the integrity of the official investigation and evidence.  Two parties were involved, the resident (Defendant – occupant) and his friend (non-occupant).
 
The friend drove a distance to visit the defendant at his home.  They were consuming alcohol and playing video games when an altercations ensued.  The non-resident was stabbed with a kitchen knife in the face and chest.  Although not fatal, the latter was potentially fatal.  While driving himself to the hospital he called 911, and concurrently the resident also did.  They each reported the altercation and injuries, but events leading to this were different.
-- Our investigation disputed the victim’s allegations and law enforcement evidence – or significant lack thereof.
 
Alleged Binding / Restraining (Expert Consultation)
-- Our agency was retained by an attorney to review the official records, reports and photographs of a reported non-assault incident of binding and restraint.
 
“The reporting victim stated she was bound around her writs and ankles, then pulled together behind her back (hog tied) with a heavy nylon rope.  The rope was missing upon arrival of law enforcement, and the one neighbor she reported to had since passed away.  One patrol officer was assigned to investigate and took one picture of the bedroom in which it was reported to have occurred.  The room was clean, no disarray and the bed made and undisturbed.  The patrol officer also took pictures of injuries the alleged victim described to have occurred.  A detective was assigned and photographs of the alleged victim's injuries were taken over a period of days.  In the non-custodial interview the defendant asked the detective if he would be arrested - to which he was told he would.  The interview continued for over two hours, with no evidence of wrongdoing or dishonesty as to his recollection of events.  At the conclusion of the interview he was arrested.”
-- Our investigation disputed the victim’s allegations and law enforcement evidence – or significant lack thereof.

Mennonite witness jailed for contempt in capital case keeps faith
A private investigator who was locked up for refusing to testify in a Colorado death penalty case because it would violate her religious beliefs as a Mennonite said keeping her behind bars won't change her mind.
 
"I don’t believe that any amount of jail would ever shake my faith," Greta Lindecrantz told reporters Thursday from the Arapahoe County Jail, where she's been held on contempt since Monday.

Enacted in 1970 as a consumer protection bill (focused on assisting those seeking the use everyday credit facilities (i.e. credit cards), the statute has morphed into a morass of red tape which has created a legal minefield for employers of all sizes. This statute has been amended approximately 19 times.

Legislative Activity Summary

GPS / Geolocational Legislation
Lobbyit's recent activity on behalf of NCISS consisted significantly of preparation for NCISS's 2018 "Hit the Hill" Congressional fly-in, including updating legislative advocacy materials.  Upon Congressman Chaffetz's retirement in late 2017, we hoped the bill would die a quiet death in the House.  While prospects for passage are still somewhat remote -- in either Chamber -- this legislation received a new lease on life in the house with its re-introduction by Congressman Blake Farenthold (R-Tx).  Like Cong. Chaffetz, Farenthold is considered a more doctrinaire conservative, and the renewed introduction of the legislation gave cause for concern.
