2016 has been a great year!
We have brought answers to families seeking closure, and assisted attorneys in bringing their clients the strongest legal investigative and expert consultation skills and experience in traumatic Personal Injury, Negligence and Death / Serious Bodily Injury in Civil, Criminal and Probate litigation. We also found a growing and renewed interest in our Individual Locates, Backgrounds and Assets & Liabilities investigations.

Time is Money - Multi-tasking is Time Recovered
 
Time, education, training and experience are the key to the success of every professional - and professional investigators are one of the unique professions for this - together with attorneys, doctors, accountants and others.
 
We strive for more education and training, each passing day is another day of experience.  However, time is a commodity which is a constant - it passes and renews each day.  Time is never shorter or longer - unless we waste it or creatively make time our partner. Our time is either productive or not; billable or not.
 
Over the last 29 years we have seen many time-savers come and go.  Some save time, others seem to take more time.  From templates to texting, for better or for worse, technology is with us and impacts us 24/7. When Dean started the agency, in 1987, he had an answering machine which notified a beeper and then he used payphones or courtesy phones to return calls from the field. Later would come a fax and text paging - then email, followed by cell phones and mobile computing. By 1995 a complete mobile office as needed and Dean had mobile technology before law enforcement. From late 2012 through early 2015, while traveling in our RV, we learned how to be more mobile, more paperless, and more creative with our time.

Analyzing the Death and Investigation of Justice Antonin Scalia (from 2/22/2016)
With the recent death of US Supreme Court Justice Antonin Scalia (02/13/2016), and the questions surrounding it, a real-world understanding of death investigations is needed.  Death investigation is not limited to homicide investigations, and is best conducted by trained medicolegal death investigators overseen by a forensic pathologist.  What makes us qualified to evaluate the death and investigation, as reported, of Justice Antonin Scalia?  Below is a summary of our experience, with a detailed experience following this article.

Special Announcement - Dean Beers Elected NCISS President 2016-2017 (from 4/17/2016)
Dean most recently served as 1st Vice President, and previously as both 2nd and 3rd Vice Presidents, as well as Secretary, Regional Director and Membership committee during his membership with NCISS.
 
NCISS Wunder Award
In addition to his election as NCISS President, Dean was also the recipient of the The Wunder Award (2nd highest NCISS honor). He has previously been the first recipient of the 3rd highest honor, The Vinson Award.

NALI Editor Publisher Honorable Mention Award (from 5/12/2016)
Our agency is very proud to announce that NALI has, for the third time, honored Dean with a publisher's award.  This is a great honor to be recognized by your peers.  This article will be in a future edition of Dean’s next legal investigation book.  His current book - Practical Methods for Legal Investigations:  Concepts and Protocols in Civil and Criminal Cases was published by CRC Press in February 2010 - www.PracticalMethodsForLegalInvestigations.com.
 
“An Expert Consultation May Save the Day” was published in the Fall 2015 issue of The Legal Investigator, official journal of the National Association of Legal Investigators.  Dean is also a co-editor for the Forensic Focus section.

Investigator Ethics Involving Social Media (from 7/18/2016)
Emerging technologies - from drones and GPS to social media and cloud storage - they may help or hinder our investigations, and become the subject of laws, regulations and ethics.  Ethics are the moral fiber of a profession.  Ethics are not optional - they are as required as laws and regulations - and violating them may lead to administrative punishments from fines to license revocations.  The actions of a private investigator, particularly when retained by an attorney, are guided by our own ethics and that of attorneys - and any violations can impact the attorney.  Ethics are promulgated by the American Bar Association, and also by the individual state bar associations.  It is important to know those applicable to the states in which you conduct business.

TIDBITS FROM OUR PROFESSION
From NCISS
Lobbyit's November activity consisted almost entirely of talking to numerous congressional offices about what would happen as 2016 comes to a close, and what we might expect in early 2017.

As NCISS members know quite well, many of our primary policy concerns related to a series of Department of Labor rules (Overtime, Persuader, Micro-Union, Joint Employer, etc. - all the subject of earlier NCISS dispatches).
What is clear for next year, however, is that legislation is going to move.  In most cases, these measures will be wide ranging and complex, like an overhaul of the tax system.

As such, the coming Congress presents both promise and peril.  While NCISS might see problematic issues like data broker and gun regulation recede from the agenda, much legislation will be moving, which presents both opportunities to add NCISS priorities, but also the surety of the law of unintended consequences.  NCISS and Lobbyit will be busy scouring these legislative materials to ensure that provisions don't pop up which could inadvertently hurt our profession.

NCISS Legal Alert - Overtime Rule Blocked!
Yesterday, U.S. District Judge Amos Mazzant of the Eastern District of Texas imposed a nationwide injunction against the Obama Administration's "overtime" rule (the subject of prior NCISS issue alerts). Judge Mazzant held that the Labor Department regulation exceeded the authority granted it by Congress, which he said gave Labor the right to define which workers are considered salaried but only based on the duties they performed, not by how much they made.

National Council of Investigation and Security Services (www.NCISS.org)
Each day we find an increasing number of problems confronting the orderly growth of our profession. These problems include, among others: overly restrictive legislation regarding training and standards, proliferation of legislation requiring local licensing, public misunderstanding and misinformation on the role and contribution of private investigators and security services, and an uninformed media. It is the role of NCISS to meet and solve these problems while seeking to uncover and recommend action on any hidden potential problems which may have an effect on our profession.

  • Legal Basis in Family Law Investigations

Private investigators oftentimes have the stigma of taking on any case for any reason. Advanced Professional Investigations has worked hard to change that perception through educating the public and clients on what a professional investigator does and how we think. We do, however, still get the calls from individuals that want their husband or wife followed to see if they are cheating or find out if we can bug their cell phone or computer. In our office, the protocol is to determine if the case has a legal basis or is purely need to know. As Colorado is a no-fault state for divorce, the only time we accept a domestic case is if there is an attorney involved and if the attorney feels our help is not only warranted, but also beneficial to their legal case.

Having worked full time as a Colorado private investigator for nearly 15 years, and for over 10 years as a business owner, I’ve been able to experience the ebbs and flows – the ups and downs of the profession.
