Team Beers Takes Pride in Helping Victims

In October 2011 a local newspaper did this business profile on us.  Since that time our home base has moved to Fort Collins, Colorado; however, our services are primarily national expert consultants through our extensive personal network of investigators.

Q:  Explain what you do.
A: We are expert consultants and legal investigators of personal injury, negligence and death in civil, criminal and probate litigation and related matters.

Q: Private investigators have been glamorized on television, movies and plays as masters of disguise and intrigue. What is it like in reality?
A: Particularly in our specialties, there is not much glamour - but there is satisfaction in helping those victimized and affected by traumatic, often fatal, events.

Q: What kind of investigations make up the bulk of your business?
A: Expert consultations in injuries, injury causation and death have become increasingly in demand.

These may be in civil or criminal cases, as well as what is referred to as equivocal death investigation - when there is a question as to the cause and manner of death, at least in the view of the family or their legal representative.

Civil investigations, from motor vehicle collisions to negligence of another, is the bulk of the legal investigative, followed by criminal defense.

Q: You have branched out into forensic investigations. What is the difference between that and private investigations?
A: We began forensic investigations in 2000 and now concentrate primarily in that area as it relates to our specialized services. Private investigators play an important role in our society and legal system - for the individual, business, insurance, attorney and others. Private investigators may provide surveillance, backgrounds, process service and other services in workplace, domestic and also civil and criminal cases.

Legal investigators focus on civil plaintiff (representing a person who is alleging to have been wronged by the actions of another) or criminal defense. Forensic investigations focuses on the facts and evidence necessary for our judicial system, particularly the judge and jury, to make informed decisions. We like to say that forensics represents Facts or Reasonable Evidence Necessitating Systematic Investigative and Critical Solutions.

Q: Generally speaking, what's been your most exciting case?
A: Any case in which we have helped a client, victim or family member begin to find solutions and closure to a traumatic event. It is not possible to be in their position, but we feel with our help on their legal team, we can make their position better.

One memorable case involved extensive work for the victim of a motor vehicle collision who could not recall what happened. We were able to prove, through witnesses and scene investigation, what happened and that the responsible party's statements were false and not possible to have happened as they reported.

Another also involved a motor vehicle collision and being able to prove for the decedent's family that the responsible party, although in possession of a narcotic legally, had used it illegally just before the collision, proving his negligence and not that of the decedent.

Q: How did you get into the investigation business?
A: Dean worked for a local family-owned grocery store and began deciding a career change was necessary. Having long had an interest in investigations, he attempted to work for other investigators but none was hiring during a troubling economic time. Instead, he decided to form his own agency and teach himself what needed to be done. In 1996, Karen began expanding her knowledge and working cases.

Q: Tell our readers one thing that would surprise them about your business.
A: Private investigations has always been one of the fastest-growing small businesses in the U.S. It also has one of the lowest rates of survival in under five years. A recent study found that, just as with 20 years ago, there are as many new investigators (under two years) as veteran (over 15 years). Dean and Karen are also one of three husband and wife Certified Criminal Defense Investigator teams in the U.S. and Dean is one of fewer than 80 certified legal investigators worldwide.

What Legal Investigation Books are Recommended?

What Legal Investigation Books Are Recommended?

There are many good investigative books to choose from, with two written by the principals of this agency.  Your choice of books is directly related to your choice of specialties, certifications and educational desires.  We have put together some of the < best books used in investigative certifications >.

One of the most current books is AFI-LLC's own < Practical Methods for Legal Investigations:  Concepts and Protocols in Civil and Criminal Cases' >

Legal investigators are responsible for providing factual evidence – as the fact finders, they are the foundation for the attorneys they work with daily. The attorney is responsible for forming and implementing the legal strategy and presenting it to the judge or jury. The legal investigator provides checks and balances to ensure that no evidence is being forced upon a theory, and that no theory is being forced upon the evidence.

Practical Methods for Legal Investigations: Concepts and Protocols in Civil and Criminal Cases presents legal investigators with a step-by-step process that reveals how to methodically find and report evidence in every aspect of the investigative process. Similar to the scientific principle of using research to prove or disprove a theory, the author’s Investigative Protocol is designed to find the facts that prove or disprove criminal charges, civil allegations, or elements thereof. The book includes case studies that clearly detail how the process of the Investigative Protocol applies to every assignment of the case and to the case as a whole. Comprehensive and methodical, the system provides a map to the truth.

Ethics for the Professional Investigator and Attorney

http://ethics.PrivateInvestigations.org

One of the most common mistakes a professional investigator makes is understanding that the attorney-PI relationship is an attorney-agent relationship, and all actions by the PI are governed by the same ethics as the attorney.

Its here, its online and its FREE! I finally put together a few common ethical concerns for private investigators. Ethics are important, so important that I am sharing this eBook FREE. No catches, no gimmicks...just go download for your specific reader.

The value and importance of our professional ethics cannot be overstated. Ethics are often seen as morals, they are not, though one will impact the other. Morals are behavioral guides that are personal and individualistic. Ethics are rules of behavior for an individual through a group – such as an association or profession.

Feel free to contact us if you have any questions.  Other books and resources are at www.PrivateInvestigations.org

Letters from Yesteryear!
We are very proud that Karen has completed her first book - a non-fiction short piece based on actual letters from an ordinary frontier family.

"One of the best ways to learn about history is from people who actually lived and documented what they experienced.  The book Letters From Yesteryear is a collection of letters written between the years 1879 and 1900.  These letters were written with no intent other than to keep in contact with family.  Through the innocent, honest writings of these letters, historical information is gained regarding the late 1800’s in parts of the United States of America." -- Karen

Proving a Person Deceased

Proving a Person Deceased

There are many reasons to need to prove a person deceased, usually it involves probate, or the unavailability of a victim or witness, and sometimes in a civil case that a witness or party is deceased.  We have also seen it when investigating identity theft and false identities.  20 years ago it was much easier to verify a death through public records, but identity theft and other personal privacy concerns changed that.

Proving a death depends on several factors - from where to how, and if they were transient, etc.

First check the Social Security Death Claims Index (common genealogy sites and some investigative databases).  This does not have every death, just those in which burial and/or survivor SSA benefits were applied for.  The information is updated quarterly for the most part.  Some investigative databases have this as a stand alone search, or when you run the name or SSN the search is included.

If that is inconclusive, you can check the more common national obituary sites.  These do not have every obituary, but collect them from the major regional newspapers and contributing funeral homes.  Not everyone that dies has an obituary, and of course not every source is included.  www.arrangeonline.com and www.legacy.com are two sources.

After that you need to know the area that the person likely died.  I believe every state restricts information regarding death certificates to next-of-kin, so contacting the state or county vital stats office won't help.  Check the following, and simply tell them you are confirming the death of a person.  The more information you have the better - full name (and nicknames / spellings), DOB, SSN, etc.  Check local newspapers, funeral homes, coroner or medical examiner offices, hospice care, etc.  Also check the clerk and recorder or other county official records repository for deeds, etc. - someone may have recorded a claim, will, etc.  Check the court probate records to see.

There is no central information source for all deaths at any state, federal or local level.  It is a hit and miss, the more information you have the better.

Forensic Testimonial Recovery

(oops - the blog title should be 'Forensic Testimonial Evidence Recovery - but if its changed now, social network links won't work.  Our apologies).

Forensic Interviews and the "Forensic Testimonial Evidence Recovery (FTER) Method"

From:  Associates in Forensic Investigations, LLC
Book Review 'Forensic Interview - Forensic Testimonial
Evidence Recovery (FTER) Method
Contact:  Dean A. Beers, CLI, CCDI and Karen S. Beers, BSW, CCDI

Associates in Forensic Investigations LLC is pleased to announce their review of 'Forensic Interview - FTER Method' by renowned criminal defense investigator, Brandon Perron, CCDI.

Brandon Perron's first book, 'Uncovering Reasonable Doubt:  The Component Method' has been used by public and private sector investigators since 1998 and is the foundation of all competent criminal defense training and investigations.  Brandon has taken this concept to a new level with his latest book and methodology.
Interviewing is one of the fundamental skills required of almost every public and private sector investigator.  This skill is relevant to all areas of investigations – from civil to workers compensation, and including law enforcement.  This book was written for all investigators – from the novice to the experienced.

“Forensic Testimonial Evidence Recovery – The FTER Method” is described as the art and science of the interview.  There are three basic areas of the book – evidence and fundamental concepts, application of the concepts, and advanced techniques.  Brandon takes the investigator through the understanding of evidence, fact finding and recovery of evidence.  The FTER Method takes the evidentiary process further in defining testimonial evidence.

This book demonstrates the interview skills necessary, and how to apply those skills.  Leaders of the investigative profession may have different methodologies, but they all share the same purpose and fundamentals.  The reader is challenged to learn, adapt and apply the concepts – including with practical mini-tests throughout each chapter.

Forensic Testimonial Evidence Recovery is a strong concept, that when appropriately applied, is a powerful technique.  When applied consistently as part of an overall investigative methodology, it strengthens investigation and strategy.

It is important to pay close attention to the application of this FTER Method before continuing the book and learning process.  The basic interview techniques are necessary to conduct effective fact-finding and truth verification interviews.  The next level is for the experienced investigator in the stages of the advanced interviewing techniques.  The advanced skills include visual imagery, Kinesics techniques, and how the basic interview is further assessed and advanced using these techniques.

In 13 chapters and a summary, renowned and respected Brandon Perron, CCDI, takes the criminal defense investigator down a road that is not well traveled but should be.  He maps out the concepts of the FTER Method, demonstrating and imparting the art and science of the forensic interview and related testimonial evidence recovery.

To no surprise, Brandon bridges the art and science in a clear and concise methodology and plan of action.  He packs a lot of punch in this book in the fight to assure every defendant is able to exercise their Constitutional right to an adequate defense.  As a stand-alone book, the FTER Method is excellent.  With its predecessor, “Uncovering Reasonable Doubt:  The Component Method”, it is a powerful testament to the skills and necessity of a criminal defense investigator and how they can and will succeed in the most important role of our adversarial judicial system.

Is the interview an art or science?  Brandon reminds us, but you will need to pick up the book for the answer.  I strongly suggest that this book be part of every investigator’s library.

This book is written by Brandon Perron, a Certified Criminal Defense Investigator (CCDI).  He operates Investigative Support Specialists, Inc. in Stuart FL and is founder of the Criminal Defense Investigation Training Council and the coveted Certified Criminal Defense Investigator professional designation.  He has over two decades in private criminal defense investigations, not including graduating the United States Air Force Security Police Academy and the United States Army Military Police Investigator School and as a Criminal Investigator with the United States Air Force, then as a Florida Public Defender Investigator.

Wrongful Convictions and Comprehensive Investigations

Wrongful Convictions and Comprehensive Investigations

Courtesy of Kris Cantil (Kane Conslting, UT) - "At the heart of an effective defense is an adequate investigation. Without sufficient investigation, a defense attorney, no matter how intelligent or persuasive in court, renders deficient performance and jeopardizes his client's defense." Richter v. Hickman,578 F.3d 944, 946 (9th Cir. 2009).

Feature Article from the June AFI-LLC Newsletter
Wrongful Convictions and Comprehensive Investigations
Karen S. Beers, BSW, CCDI

(for the complete newsletter - Click Here)

False confessions and false accusations seem to be the “norm” these days.  Add to the mix one-angle sighted police officers, prosecutors, and jurors, you get wrongful convictions.  These wrongful convictions take years to undo and those years taken away from the wrongfully convicted can never be given back.

Even when a lawsuit brings monetary gains to the wrongfully convicted, the wrong done can never be erased from their minds as well as the minds of others.  Even when you have “exonerated” on your criminal record, some people believe you must have done something and are only getting off on some legal technicality.  Yes, those legal technicalities do exist although rare, and the numbers keep mounting up for the innocent victims of our judicial system.

Although you cannot have a perfect system, simple changes can add up to fewer wrongful convictions.  To start what can be done is to conduct thorough investigations.  Looking at all angles of facts and then following through until you prove or disprove any evidence obtained.  Too often evidence is tossed aside because it does not fit the current mind set of the individual doing the investigation, whether it is in the government or private sector.  This type of investigation is not a thorough investigation, it is a lazy one-angled investigation, and it is assisting in the devastation of the wrongfully accused.

Money seems to be an issue in conducting a thorough investigation.  However, the money utilized in the investigative process is far less than the money lost in law suits.  Educating the public on “real” investigations and what it truly takes to follow through rather than what they see on television, which has become known as the “CSI” effect.  These individuals watching CSI may be part of a jury one day, which could lead to either the innocent being sent to prison or possibly death, or the guilty being set free back into our society.

Not only do the wrongfully convicted live a nightmare in prison, the families and friends of the victims in these cases have to relive their nightmare all over again.  Remember, when the wrongfully convicted are put behind bars, the families and friends of the victims believe the right person was convicted in the crime of their loved ones.  Then to find out years later the wrong person was convicted in the crime, the fight for their personal justice starts all over again.

All professional investigators should pride themselves in conducting thorough investigations no matter how big or small the case may be.  It does not matter the type of case working on, they need to be worked from every angle possible.  A one-angled investigation is not acceptable.  Think of looking through the lens of a camera, you can take a one-angled photo which may give you a few facts needed in your investigation; or you can take a panoramic photo and get perhaps all of the facts, the good, the bad, and the ugly, needed in your investigation.
